1. HOW TO ENTER THE SWEEPSTAKES
a. CBS Radio's "Brother P-Touch Organize and Relax Giveaway" ("Sweepstakes") will begin on 05/26/2008 at 12:00:00 AM Eastern Time ("ET") and will end on 06/15/2008 at 11:59:59 PM ET (the "Entry Dates"). For purposes of this promotion, an "Entry Week" begins on Monday, at 12:00:00 AM ET and ends on Sunday at 11:59:59 PM ET.
b. Visit participating CBS Radio station web sites during the Entry Dates and select the Brother P-Touch Organize and Relax Giveaway banner to open the Brother P-Touch Micro Site window ("Micro Site") or visit the Micro Site directly at www.labelyourselfawinner.com. To enter the Sweepstakes during the Entry Dates, entrants will be required to submit answers to three multiple choice questions about their preferences as well as their first name and last name, complete address, city, state, zip code, telephone number, date of birth, and a valid email address in the online entry form. Only one internet entry per person and one internet entry per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property of the Administrator and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Administrator. Administrator's computer is the official time keeping device for the sweepstakes. The Sponsor and Administrator are not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches.
c. As described below, there will be three (3) Entry Weeks during the Entry Period, and three (3) random drawings for entries received through the end of each Entry Week (including entries submitted in preceding Entry Weeks, as applicable). Only entries submitted during the Entry Dates will be included in the Sweepstakes random drawing. Entries submitted after the Entry Dates will not be eligible for the Sweepstakes drawing.
d. By participating in the Sweepstakes, contestants consent to the disclosure of their entry information to the Sponsor and Administrator for verification and for marketing and promotional purposes related to this Sweepstakes.
e. Prizes will be awarded pending verification of eligibility.
2. ELIGIBILITY RESTRICTIONS
a. The Sweepstakes is open to all persons who are 18 years of age or older and who reside in the 50 United States or D.C. Employees of Brother International Corporation, CBS Radio Inc., its licensee, and each of their corporate parents, subsidiaries, and affiliates, advertising agencies, participating sponsors/promotional partners, other radio stations in the same metropolitan area as the participating CBS Radio stations and the members of their immediate families (mother, father, step-mother, step-father, siblings, children, spouse) (a "Household") are ineligible to participate or win. Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void outside the United States and where prohibited.
b. Only one Winner per Household is permitted in the Sweepstakes.
c. Entrants are required to provide truthful information and the Administrator will reject and delete any entry that it discovers to be false or fraudulent. The Administrator will disqualify any entry from individuals who do not meet the eligibility requirements, and the Administrator will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children's Online Privacy Protection Act.
3. PRIZES:
a. Three (3) Grand Prizes: Each Grand Prize is a trip for two to Miami, Florida with accommodations at the Mandarin Oriental Hotel in Miami. Approximate Retail Value ("ARV"): $3,500 each. The grand prize winners must book their trip within forty-five (45) days of winning and complete the trip within one (1) year of winning or prize will be forfeited. Prize includes round trip coach class air transportation to Miami, Florida from a major airport nearest winner's residence (as determined by Administrator). Hotel spa package includes 3 nights in the hotel, breakfast, and up to three choices of facials, massages, and other treatments throughout the 3 day period. Trip is subject to availability and blackout dates, and travel must be roundtrip. Administrator will determine airline and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by the Administrator's airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Unless child of winner, travel companion must be eighteen (18) years of age or older as of the date of departure and must travel on same itinerary and at the same time as the winner. If winner is a minor in his/her state of residence, travel companion must be winner's parent/legal guardian. Travel companion must execute liability/publicity releases prior to issuance of travel documents. If in the judgment of Administrator air travel is not required due to winner's proximity to prize location, ground transportation will be substituted for roundtrip air travel at Administrator's sole discretion. Administrator will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Administrator is not responsible if any scheduled event is delayed, postponed or cancelled for any reason, in which event that portion of prize is forfeited in its entirety and no substitution will be provided except as in Administrator's sole discretion. Actual ARV for prizes may vary based on airfare fluctuations and distance between departure and destination. Winner will not receive difference between actual and approximate retail value.
b. Fifteen (15) Qualifying Prizes: Each Qualifying Prize is a $100 spafinder.com gift certificate. (ARV: $100 each.)
c. Thirty (30) Instant Prizes: Each Instant Prize is a Brother P-Touch labeler. (ARV: $49 each.)
d. The aggregate ARV for all prizes is $13,470.
e. All prizes or prize certificates will be mailed to the winner. The winner will forfeit any prize or prize certificate not claimed within forty-five (45) days of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Administrator is not responsible for the safe arrival of a prize or prize certificate.
f. There is no substitution, transfer, or cash equivalent for prizes, except that the Administrator may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. SELECTION OF WINNERS
a. Decisions of Administrator with respect to the sweepstakes are final.
b. On or about the first business day following each Entry Week, the Administrator will select ten (10) potential Instant Prize winners, five (5) potential Qualifying Prize winners, and one (1) potential Grand Prize winner in a random drawing of all eligible entries received during the Entry Dates through the end of the preceding Entry Week. A total of thirty (30) potential Instant Prize winners, fifteen (15) potential Qualifying Prize winners, and three (3) potential Grand Prize winners will be selected following all three Entry Weeks. Odds of winning in each random drawing depend on the number of entries received. The Winner need not be present or listening to win.
c. The Winner will be notified via email of how to claim the prize or prize certificate and will be required to execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form within ten (10) business days of notification attempt or prize will be forfeited and an alternate Winner may be chosen. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner forfeits prize.
5. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners will be required to complete and submit an IRS Form W-9 with the winner's full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Administrator in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize.
b. By participating in the Promotion, the winners agree to have their name, city, state, voice, or likeness used in any advertising or broadcasting material relating to this Promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Administrator in its sole discretion may require sweepstakes winners (and their travel companions, if any) to sign a liability release, agreeing to hold Sponsor, Administrator, the participating CBS Radio Stations, and each of their parent, subsidiary and affiliated entities, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the sweepstakes.
d. The Administrator, in is sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Administrator's website or Micro Site, or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the sweepstakes if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
e. If due to circumstances beyond the control of the Administrator, an event related to any prize is delayed, rescheduled, postponed or cancelled, the Administrator reserves the right, but not the obligation, to cancel or modify the Sweepstakes and shall not be required to award a substitute prize.
f. Failure to comply with the sweepstakes rules may result in an entrant's disqualification solely at the discretion of the Administrator.
g. The Sponsor and Administrator are not responsible for typographical or other errors in the printing, the offering or the administration of the Sweepstakes, or in the announcement of a prize.
h. Copies of the written Sweepstakes rules and a list of Winners (when complete) are available during regular business hours at the main studio of CBS Radio at 1515 Broadway 46th Floor, New York, NY 10036 or by sending a SASE to the same address (VT residents may omit return postage). All such requests must be received within 30 days following completion of the Promotion.
6. INTERNET SWEEPSTAKES PRIVACY POLICY
a. By use of this website and by entering the Sweepstakes, you agree to the Brother P-Touch Micro Site Terms of Use Agreement and to the use of your personal information as described in the Brother P-Touch Micro Site Privacy Policy located at: www.labelyourselfawinner.com
